IceTV epg has Melb channel 9 at 10.40pm showing True CSI but channel 9 is advertising at same time CSI: NY

Yeah! Same here in Qld Sunshinecoast - WIN (regional 9) is in fact showing CSI-NY Right now.

Scheduling for 9 and affiliates is currently affected by legal orders that restrict our access to EPG data. Unfortunately, the repeat episode of CSI:NY wasn't promoted until that night, which is why True CSI was still in the schedule (as per last week).

We have taken note of the change and will keep an eye on this timeslot for next week.
